Welcome to crisvilla.com (the "Site"), operated by Cris Villa ("Cris Villa," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Site, including browsing, purchasing artwork, and any other services offered here. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Cris Villa is an independent artist based in New Jersey, USA. This Site sells exclusively to customers within the United States.

2. Intellectual Property

All artwork, images, photographs, designs, text, and other content on this Site are the original creative work of Cris Villa and are protected by copyright and other intellectual property laws.

• Purchasing an original piece or print transfers ownership of the physical object only. It does not transfer copyright, reproduction rights, or any other intellectual property rights in the artwork.

• You may not reproduce, distribute, display publicly, create derivative works from, or use any artwork or Site content for commercial purposes without prior written permission from Cris Villa.

• Personal, non-commercial photography of purchased pieces (e.g., sharing on personal social media with credit) is generally welcome — cris@crisvilla.com.

3. Products & Availability

• Original artworks are one-of-a-kind. Once sold, an original piece is no longer available.

• Prints or reproductions (if offered) are produced in limited or open editions (ill be specified in the listing), and details such as size, paper, and framing will be described on each product listing.

• We make reasonable efforts to display colors and details accurately, but slight variations may occur between the artwork as displayed on screen and in person, due to lighting, monitor settings, and the handmade nature of original work.

4. Pricing & Payment

• All prices are listed in US dollars (USD) and are subject to change without notice until an order is confirmed.

• Applicable US sales tax and shipping costs will be calculated at checkout or communicated separately for custom orders.

• Payment is due in full at the time of purchase unless otherwise agreed in writing (e.g., for commissioned work with a deposit structure).

• We use Stripe, PayPal and Squarespace Payments to process payments securely; we do not store your full payment card details.

5. Custom & Commissioned Work

If you commission a custom piece:

• A non-refundable deposit of 50% may be required before work begins.

• Timelines, scope, size, and pricing will be confirmed in writing before work starts.

• Cris Villa retains final artistic discretion over the creative execution of commissioned work, within the agreed brief.

• Copyright in commissioned work remains with Cris Villa unless otherwise agreed in writing.

6. Shipping & Delivery

• Shipping is available within the United States only. Shipping times and costs vary by destination and will be provided at checkout or by direct communication for larger/original works.

• Cris Villa is not responsible for delays caused by carriers or events outside our reasonable control.

• Risk of loss or damage passes to you upon delivery to the carrier.

7. Returns, Exchanges & Cancellations

• Original artwork may be returned within 14 days of delivery if it arrives damaged or significantly not as described. Buyer is responsible for return shipping unless the item was damaged in transit or misrepresented.

• Custom/commissioned pieces are generally non-refundable once work has commenced, except where the work is materially defective.

8. Limitation of Liability

To the fullest extent permitted by law, Cris Villa is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of artwork, including but not limited to loss of enjoyment, data, or business opportunity. Our total liability for any claim will not exceed the amount you paid for the relevant item.

Nothing in these Terms limits liability that cannot be excluded under applicable law (such as liability for gross negligence, fraud, or statutory consumer rights).

9. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.

• Attempt to copy, scrape, or reproduce Site content without authorization.

• Interfere with the Site's security or normal operation.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your personal information.
